Hello, My clinic made me pre-pay for my medical procedures in June. I hit my out of pocket maximum at the end of July and did not have to pay for any more services. This week, I reached out to the billing department for a refund and they said they cannot issue it to me yet since they are waiting to be paid by insurance for recent visits. I followed up with a detailed breakdown of the costs and EOB/claims showing that I don’t owe them any money. All of remaining balance will be paid by insurance. But they still refused until they received all the payments. Is this allowed? I feel like they are holding my money hostage when it’s between the clinic and insurance to figure out. Is there anything else I can say or do? Are there any legal laws that dictate a time frame by which they have to pay me back. To make it worst, they said they only process refunds in the 3rd week of the month and checks are sent out in the 4th week.
