My insurance won’t pay for my brother’s ER bill

My brother (at the time he was 14 years old) was riding his bike and hit by a car and sent to ER. He’s fine now but needed to stay there for a day and of course go to an orthopedic for a few months since he fractured his ankle.

The police report says that my brother was at fault for crossing the street illegally.

My health insurance just sent me all of his ER and Ortho bills which amount to over 80k out of pocket (the ER and ortho are both covered in my health plan and within my RECOMMENDED NETWORK) . I obviously cannot pay this and the insurance is refusing to take care of these bills until I call the other party’s auto insurance and ask how much they can pay toward his bills.

My question is, what happens if the other party’s auto insurance refuses to pay for anything because my brother was at fault? Does that mean my health insurance will not cover his ER and Orthopedic bills?
