this is a pretty unique situation and i could definitely use some input. sorry if it’s a little long:
in mid-march 2020 i went on an administrative leave from work due to Covid-19. shortly after going on leave, i received an invoice from my employer for my portion of the bi-weekly premiums. i was informed that if payment wasn’t received within two weeks, my insurance would be canceled. i never specifically said “cancel my insurance” but i never sent them a dime. shortly after that email was received, i lost access to my company email.
over the following year, my administrative leave expired so i was forced to go on fmla leave, which also expired (in october 2020.) since then, i’ve remained on a vague, nondescript leave with next to no communication with my employer, the whole time assuming i was uninsured.
i received my w2 at the end of January and while doing my taxes, it appears my employer didn’t, in fact, cancel my insurance like they stated they would and had been paying 100% of my premiums from mid-march 2020 on.
two days ago, i was given an ultimatum to return to work or resign and reapply when things “return to normal.” because my doctor stated i shouldn’t return until after I’m fully vaccinated, i will be submitting my resignation.
my concern is that they will attempt to collect what they have spent on my insurance over the past year, which is a significant amount. is this something they would be allowed to do?
i have read that they may not be able to if i don’t return for medical reasons but being covid is such a unique situation and i’ve long since exhausted my fmla leave, i’m not sure if that applies. can anyone shed some light on this crazy situation for me?
i’m in minnesota if that matters.
