Is the yearly out-of-pocket max the actual maximum for covered services?

A lot of people are taking this headline as saying that insured people may start to be saddled with $50k+ ICU bills.

I was under the impression that your out of pocket costs will not go over your yearly out-of-pocket max, no matter how high your billed costs go for covered services.

Is this accurate? Or are there some demonstrated loopholes in insurance contracts that will allow companies to saddle people with tens of thousands of dollars of bills that insured patients have to pay?
