Can provider bill an office visit 99213 if visit is remote?

We changed insurance this year to an HDHP so I’m looking more closely at billing.

Looking at EOB, it seems like a mental health provider charged an office visit as well as a “medical services” item even though the visit was by video chat or phone.

Is that legit? If not, and we’ve since paid the provider the full difference between what insurance paid and what purportedly remained, can we get it back or dispute it with the credit card company?
