What is the potential penalty if my wife’s employer lets her sign up for the HSA if she’s not eligible? She’s on my “platinum” plan, but a requirement is that she is on her own employers plan as primary. She chose a high deductible plan, but she’s also offered HSA because of it. Kids will need braces, so I want the combo of insurance (which isn’t so great for braces), my FSA and her HSA. What’s the potential fallout here?
