Hello friendly Redditors Here’s my scenario – I need experts advice on this.
I reside in New Jersey
I am leaving my current employer, I plan on putting my two weeks notice in on Monday, January 3rd, with my last day intended to be on Friday, January 14th at close of business.
I’ve accepted a new job to begin on the 17th. Benefits for my new job begin on the 17th and anything for the remainder of the month is retroactively applied to that date.
The concern arises because My wife is Pregnant and due on January 20th.
About my current health plan:
My current health plan is Aetna, it is a “Self Insured” plan covered under my current employers Group Health plan.
The company has under 20 employees, and would normally be subject under NJ State Law would be to Mini Cobra.
I’m getting nervous because I’m reading that only “Fully Insured” plans are subject to Mini Cobra Continuation Laws in New Jersey and I’m getting very uneasy, because… what if my wife pops early before the 17th???
I’m guessing that as of January 1st, my healthcare for the month of January would be active for the month. My employer normally takes my healthcare costs out of my paycheck on the 1st and the 15th of every month. I would pay the company the costs of the health plan for the month in full, which I’m OK with.
Here is my question(s) that I’d really need some help with:
Question One: Am I right in assuming I’d still be covered for the entire month of January because the plan is paid for a month in advance (which is why I’d have insurance beginning January 1st?) So that would mean, I’d be covered for January, but February 1 and beyond would not be subject to mini-COBRA laws? — This is best case scenario, because my new employers coverage begins on the 17th anyway. Question Two: Am I right in reading that Self Insured plans under employers Group Health Plans are not subject to mini-COBRA continuation coverage in the State of NJ? Question Three: Can my employer just pull my coverage out from under me on Jan 3rd if he tells me that is my last day? — This is worse case scenario because if he can, AND I’m not subject to mini-COBRA because it’s a Self-Insured plan, this would leave me without coverage from the 3rd until the 17th… and if my wife pops early, I wouldn’t have coverage?
Please help me understand! I’m so nervous.
