Workplace is offering child care reimbursement. Do my stepchildren qualify as a dependent and does this affect tax filling?

My wife and I have 5 kids total, her 3 from a previous marriage and 2 of our own. My workplace just started offering child care reimbursement. Since the 3 step kids already had health insurance I did not add them to my healthcare accounts as dependents during open enrollment, which brings me to my first question: The deal with the bio dad is that 2 of them are claimed by him to the IRS. Does that affect whether or not I can claim them as dependents on my benefits enrollment?

Since my workplace is now offering child care reimbursement I would like to add them as dependents on my companies HR system since my workplace is only offering reimbursement of dependent children. Obviously we can’t violate my wife’s previous court agreement and would not be claiming them as dependents to the IRS. We file jointly

My wife has equal 50% custody and time, with all of the kids from her previous marriage and as such my step children are included in our child care expenses. My workplace only announced this program on the 25th, and it went into effect on the 28th, so it was obviously outside the open enrollment period. While it’s great that the program has been created, I don’t want to miss out on reimbursement because it was created 4 months later than the open enrollment window. But that also requires us to have a “life changing event” to add a dependent. While we have a what I have researched and found is a very reasonable life changing event to add them as dependents to my plan (reduction or loss of hours or wages), I want to make sure I’m not creating any future problems or fraudulence with any entity.
