I began on my spouse’s employer health insurance few months ago. We are friendly, and she had agreed to keep me on for the year, and then exchange I’m paying for some of her stuff we have ongoing. Our divorce just is becoming finalized (no dispute, no kids), and I called the company to find out what to do and I am in a tricky situation.
I started asking about COBRA and they showed me that it was over 300% higher cost. When I pressed the agent, she said that until and unless my spouse actually calls them and notifies the divorce with documentation, I won’t be removed and can just stay on at her expense. Me reimbursing her saves me a ton over announcing the divorce and doing Cobra. The agent kind of gave me a nod nod wink wink.
So I think my wife would be fine with this, But my problem is I’m worried that if I had some major expense and claims, the insurance company could dig in and say Aha! You didn’t tell us you were divorced! Claim denied!! So my question is, is there anything against the rules or illegal about just staying on and not telling them? Or could they deny me later on ? Any advice appreciated, and it would save so much it would even be worth asking a lawyer, if there was some specialty type of lawyer to ask.
