Covid testing and related costs – covered by federal mandate or not???

Back on Jan 8, I took my son to an urgent care for a PCR test for two reasons, a.) We were exposed to it because my husband (who we live with) tested positive and b.) School was requiring it anyway for return to school after the holidays.

At the time, there was another surge of positive cases going on, and his primary care pediatricians office was not able to handle all the testing. You couldn’t get in. I could get in with the urgent care however.

In 2021, we had done this urgent care testing process maybe 10 times between me, my husband and kid at the same urgent care. I never once got a bill. At that time I had aetna, but it was my understanding at the time that federal law was requiring the tests and related costs (facility costs, office visit, what have you) would be covered by insurance without cost sharing to the patient. When I just went back to check on the aetna site, it was showing as cost $250, covered by insurance 0, required to pay 0.

But now I have blue cross and I just got EOB stating they were declining the claim and I would owe $320. Whut. Just mind you I haven’t actually got the bill yet, but I am disputing the denial of the claim.

I thought the federal mandate for insurance was to cover these costs related to covid were still in effect? The insurance says my claim was denied because I used an urgent care for a non-emergency (which I was like well wtf constitutes an emergency and she said “life threatening” that’s a whole other ball of wax, but I’m not touching it for now).

Anyway are they still required to pay for covid tests? Everything I read online says yes, but she keeps claiming the denial of benefits is valid.
