Ex-employer sent me incorrect 1095-C and won’t fix

I worked for a company on and off for a few years on a project basis. Last February I became eligible for health coverage because I’d been there 90 days. I took dental and vision only, and not medical, because I was covered by the ACA.

A few months later I worked for them again on two separate projects. I was not re-offered any insurance because the two projects didn’t amount to 90 days. I just got my 1095-C form, and it says I was offered coverage for March and April, which is correct, but also that I was offered coverage in August, September, and October, which is incorrect.

This is a problem because I started getting a subsidy in July for the ACA that lasted til the end of the year. My understanding is you cannot get a subsidy if your employer offers you coverage.

I contacted them and said the form was incorrect for Aug, Sep, and Oct and could they please correct it and they told me the form was correct, because it relates to long- and short-term disability and life insurance and not just health insurance (I was never offered these either by the way).

I feel like they are lying to me, but I don’t understand why. How does it benefit them to falsify the form? And what can I do about this? What is my recourse if they won’t fix the form?
