I have a question regarding Maternity Leave:

Hi, as the title states, I have a question regarding maternity leave.

As a family, we are both currently working. I have my own business, and my wife works for a company and therefore receives benefits through her employer. Once we have our baby, our plan is to move to single income through (my) self-employed stream.

Ideally, she’d like to tell her employer 2 months prior to taking leave, that she doesn’t plan on coming back. She wants to do this to be ethical and to also ensure the company has adequate notice should they need to find a replacement. However, she is finding conflicting advice regarding how to propose this to HR. There’s the possibility that by just simply indicating her intentions, HR could take that to be a sign of early resignation. We’re also finding that if she doesn’t tell them and gives notice 2 weeks prior to RETURNING from maternity leave, there could be a financial penalty. Is there a way to tell them early to ensure they’re set up for success finding future employees whilst still ensuring she’s not terminated?

GRIPE: Unfortunately, this is a product of the poorly managed healthcare system here and it’s a shame that there’s a feeling of confusing surrounding a decision that’s ultimately well-intentioned towards our employer. Being that the bills associated with having child can be a massive financial burden to someone on their own insurance, we’d like to have our baby under the company’s insurance because well… that’s part of her employment package.

Any advice towards how to best handle this with HR and the employer, would be greatly appreciated.
