In-network surgeon is refusing to perform a procedure without a $3000 payment for a “workup”.

I went to the initial visit and the surgeon said we’re all good with insurance but “this service is needed to plan… surgery”, “this service will not be billed to [my] health insurance”. I called insurance and described what the workup includes and they confirmed that they can make “benefit exceptions” if the surgeon provides written confirmation that this is needed. I called the surgeon’s office and they said that they do not bill the workup to insurance, they do not work with insurance on the workup, I need to pay this or they will not proceed.

Unfortunately there is alternative surgeon within a viable distance and I don’t know how to approach this. I have a contract with my insurance company covering the in-network surgeons who insurance co has corresponding contracts with. Is my surgeon’s office in violation of their contract with the insurance company?
