Every December my company has mandatory insurance elections. I picked out an insurance plan that covers tier 4 medications at a flat rate of $350 for a 30 day supply. I received the corresponding insurance card on 12/28/2021.
Today I called into my specialty pharmacy to renew a script for Biktarvy. This is the first time I’ve utilized my new insurance card. The pharmacist told me my total would be ~$3500 for a 30 day supply. That’s the full price. The pharmacist told me she would need my updated insurance information so I gave her what was on my card. The claim didn’t go through.
After that confusing phone call, I decided to call my health insurance company who informed me the card I received on 12/28/2021 never went into effect. The insurance company representative was able to find an existing plan in my name starting 01/01/2022. This new insurance provides a 50% coinsurance for tier 4 drugs and much higher copays to see doctors than the plan I elected. I did not select the insurance I now have. I was not notified the plan I selected would not be my plan for 2022.
Is there any legal recourse I can take?
