[New York] NY State of Health not taking into account American Rescue Plan changes special subsidy for those who receive Unemployment Benefits

Under Section 9663 of the American Rescue Plan, it says that individuals receiving UI benefits during 2021 will not have their income counted above 133% of the FPL when determining their premium tax credit on the marketplace (see below).

SEC. 9663. APPLICATION OF PREMIUM TAX CREDIT IN CASE OF INDIVIDUALS RECEIVING UNEMPLOYMENT COMPENSATION DURING 2021. …

“(g) Special rule for individuals who receive unemployment compensation during 2021.—

“(1) IN GENERAL.—For purposes of this section, in the case of a taxpayer who has received, or has been approved to receive, unemployment compensation for any week beginning during 2021, for the taxable year in which such week begins—

“(A) such taxpayer shall be treated as an applicable taxpayer, and

“(B) there shall not be taken into account any household income of the taxpayer in excess of 133 percent of the poverty line for a family of the size involved.

From what I can see, this should effectively give UI recipients $0 health insurance premiums since the ARP says individuals making 100-150% of FPL are eligible for $0 premium silver plans through the marketplace.

I am on UI benefits. But when I go to sign up for a plan on NY State of Health, there’s no way to get this subsidy. I called three times and the customer service reps said they couldn’t find the subsidy in their policy guide.

Should I just sign up for a plan, pay for it without the special subsidy, and hopefully get the tax credit when I do my taxes next year?
