Question regarding adding a domestic partner to my health insurance

Hi guys,

As the title states, I’m trying to add my girlfriend to my job’s health insurance. In the forms, there’s a tax exemption waiver that needs to be signed designating my GF as a “qualified” or “non-qualified” dependent under section 152 of the internal revenue code.

I’ve been trying to search up IRC 152 to see what exactly is a qualified dependent but it’s very confusing. Just wanted to know if anyone would be able to help me better understand this so I don’t select the wrong thing then get penalized down the line on my taxes.

Additional info incase anyone needs to know. I work and live in NYC. My girlfriend and I moved in together last August and have an official certificate of domestic partnership from the NYC courts. Also my job says that regardless of which one I pick (qualified or non qualified) that she will still be eligible to receive my benefits but that decision will affect how they make tax deductions on my paychecks.

Any insight on this would appreciated!
