I was in a car accident in 2020. I was rear ended in another state I wasn’t even living in and was there all by myself. My vehicle was totaled. It was a crazy experience. I had whiplash and needed months of physical therapy. It all happened weeks before covid.
All of my medical expenses were covered by the other parties car insurance except for the urgent care visit same day of the accident. My health insurance covered this. Blue Shield. I am from California and the accident happened in Oregon.
Car insurance paid the following medical expenses for PT directly. Then, they gave me an additional small settlement one year ago at which time, I signed an arbitration agreement.
Now a year later, I’m getting voicemails from Rawlings Group, claiming on behalf of Blue Shield I owe them $400 of my settlement I received from Geico. This settlement was very small and I do not have it anymore. I was not given any indication I would owe anything additional.
The specific language used in the voicemail “I see you were in an accident two years ago. I am calling on behalf of Blue Shield to collect a debt and a payment in the amount of $400 will suffice and I see the settlement you received from Geico was larger than this amount.”
So the question I have is, given they left such detailed information on my voicemail, do I have any recourse? This seems like it at least could potentially qualify as a breach of privacy, given I haven’t actually spoken with them yet nor given them permission to share such information in a voicemail.
