Advice: Hospital stay over New Year’s with an insurance company change

In early December my wife’s appendix ruptured. We stayed a few days and were released with a plan to medically manage and remove it in 6 weeks. Things got worse and were readmitted 12/28.

We’ve been in the hospital since that time. A couple surgeries (and an emergency open appendectomy) and lots of infection control later we are hoping to leave soon.

2020 plan year we were covered by employer’s self-insured plan with a 3rd party admin.

2021 plan year we have BCBS.

According to HR, I’m up a creek and will have to pay the 2020 deductible (and costs up to the out of pocket max) and the 2021 deductible (and another out of pocket max).

Seems exceptionally unfortunate considering if this happened in even November I’d be out literally 1/2 the cash.

Does this sound about right or should I seek some additional guidance by way of a mediator or someone?
