Can you be charged for care once you have reached your OOP max?

This is more a hypothetical than a real situation. I ran across this post today and started to wonder what kind of circumstance would prompt this scenario assuming it is real.

I’m assuming this person was on a commercial plan. My understanding is because of the ACA, all non grandfathered plans have to have a OOP cap. If that’s so, unless they’re seeking OON care this should all be covered right? I can’t see why life saving treatment wouldn’t be covered. Am I missing something major?
