Mom Denied Lump Sum Cancer Policy for Pre-Existing Condition

My mother, 67, was solicited by Cigna to purchase a bunch of supplemental insurance policies. She was healthy at the time and was sold on the idea. She purchased a Cigna Lump Sum Cancer policy.

25 days after purchase, she had her annual checkup with a mammogram. The mammogram had an abnormality and she was advised to get it checked out. A month later she got more imagery, weeks later another test, etc.. Almost 2 months after the original mammogram, she was diagnosed with breast cancer. She’s going through treatment, and it’s looking like she’ll be fine, but it’s getting expensive.

She applied for the Cigna Lump Sum Cancer cash payout per her policy, they spent a month reviewing it, and have denied the payout because they’re calling it a pre-existing condition. The policy states that she can’t be diagnosed with cancer in the first 30 days of having the policy, or have a pre-existing condition.

My question is – she got a mammogram with just 5 days left in the first 30 days, but wasn’t diagnosed with cancer for almost 2 months later…. does that count as a pre-existing condition if it happened during the policy and wasn’t diagnosed until long after the 30 day period?

Anything I can do to fight back on this? Can her doctors provide anything to make a case? Any legal standing? Any advice would be most appreciated, thank you!
