Babies are in Texas NICU but I’m a California Resident

Hi everyone, I hope someone can help me navigate this.

I’m a California resident but my twin babies were born in Texas through an emergency C section delivery at just under 29 weeks.

The first 31 days are being covered by the birth mom’s insurance. After that, it will need to go on to mine. There is no option to extend on her insurance.

1) My ACA California EPO insurance through Oscar is being iffy about if they will cover the out of state out of network expenses. They will want to see the case and because the babies have been doing well, the case for their urgent stay is potentially weak. Which is ridiculous cause I can’t move them anywhere.

2) I’ve heard that the babies can apply for Texas Medicaid on their own merits if they are in the NICU for 30+ days because they automatically become residents of the hospital/state . It wouldn’t matter that I’m a California resident and it would be based on their income which would be zero. My income would be too high to qualify. I’ve spoken to social worker, case worker, Hospital Medicaid rep finance department,Texas Medicaid but no one knows about this or how to process.

Does anyone have any ideas how to navigate these two issues?
