COBRA election notice deadlines during COVID

I work for a small non profit. During COVID one of our HR employees failed to notify our health insurance provider that an employee was voluntarily terminated. Once it was discovered on the bill, the coverage was terminated and a COBRA election notice was sent. Our organization paid for the coverage for two months and has no plans to collect the premium from the terminated employee. This happened during the national health emergency and would have been caught sooner under normal circumstances. With the new Covid rules, will this require us to file the excise tax penalty form with the IRS?
