Made a mistake on my spouse’s eligibility. Is there anything I can do now?

The verbiage during enrollment for my health insurance was vague about if my spouse qualified for enrollment in my plan but I didn’t think twice about it. Originally it asked if my spouse “has access” to health insurance through their provider which I should have questioned, but I didn’t and now I’m starting to freak out. I thought has access meant “is your spouse participating in a plan from their employer”.

When I got a dependent verification form in the section that is specifically for my spouse’s employer it says “regardless of particpation” which had I seen on the eligibility matrix or been prompted for during enrollment would have immediately known my spouse would not be eligible because my spouse’s employer does offer insurance.

Assuming my spouse is not eligible, which means they will not be added to my insurance, is it possible to use a Special Enrollment Period loss of coverage due to a 26th birthday within 30 days of today even though open enrollment was declined originally?

In short: is there any reason a special enrollment period would not be recognized for the full length of time? (Eg. Enrollment declined shortly before or after the event)
